Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of the KEZUMA platform ("the Service"), operated by KEZUMA ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
If you are using the Service on behalf of a group or organisation, you represent that you have authority to bind that group to these Terms.
2. What KEZUMA is
KEZUMA is a digital ledger and governance platform for savings groups. We provide tools to record contributions, track rotations, maintain security balances, and generate statements.
KEZUMA is not a bank, financial services provider, or payment institution. We do not hold, move, invest, or custody money. All money remains in your group's own bank account or under your group's direct control.
3. Your account
You must provide accurate information when registering. You are responsible for keeping your password secure and for all activity on your account. Notify us immediately at hello@kezuma.co.za if you suspect unauthorised access.
You must be at least 18 years old to create an account.
4. Your group's responsibilities
Your group is responsible for:
- The accuracy of information recorded on the platform
- Ensuring all group members consent to using KEZUMA
- Complying with your group's own constitution and applicable law
- The actual collection, custody, and payout of money
- Verifying member identities where required by law
5. Secure Rotation™
Secure Rotation™ is a software feature that enforces group-defined rules about when payouts may be released. It is not a guarantee, insurance product, or financial instrument. It helps your group enforce its own rules; it does not protect against all losses.
Your group decides its own security rules. KEZUMA enforces those rules mechanically.
6. Subscriptions and billing
KEZUMA offers a free tier and paid tiers ("Pro", "Business"). Paid subscriptions are billed in advance via EFT to the account details provided on your invoice.
Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel any time from your group settings — your plan stays active until the end of the paid period.
We may change our pricing with 30 days' notice. Existing subscribers are grandfathered for the remainder of their current period.
7. Refunds
We do not offer refunds for partial billing periods. If you believe you were charged in error, contact billing@kezuma.co.za within 14 days.
8. Acceptable use
You agree not to use KEZUMA to:
- Conduct fraud, money laundering, or any illegal activity
- Operate pyramid schemes or unregistered investment schemes
- Impersonate others or misrepresent your identity
- Interfere with the Service or other users' access
- Violate any applicable law or regulation
We may suspend or terminate accounts that violate these rules, with or without notice.
9. Data and privacy
Our handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.
10. Service availability
We aim to keep KEZUMA available at all times but do not guarantee uninterrupted service. We may perform maintenance, update features, or temporarily suspend access. We are not liable for losses caused by service interruptions.
11. Limitation of liability
To the maximum extent permitted by law, KEZUMA is provided "as is" and we make no warranties about its fitness for a particular purpose. We are not liable for:
- Group decisions about contributions, payouts, or membership
- Members failing to pay or disappearing
- Disputes between group members
- Loss of money held outside the platform
- Any indirect, incidental, or consequential damages
Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
12. Termination
You may stop using KEZUMA at any time. We may terminate your account if you breach these Terms. On termination, we'll retain data as required by law, then delete the rest within 90 days.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify you by email at least 14 days before the change takes effect. Continued use after that date means you accept the new Terms.
14. Governing law
These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in the courts of South Africa.
